REGISTRAR OF CPSA LACKS CREDIBILITY

Premier Stelmach received copies of the following six letters (by Registered Mail) dated Jan. 12/11.
These six letters show clearly that Dr. T. Theman (Registrar - CPSA) lacks credibility.
The CPSA needs to be reformed.  Premier Stelmach refuses to even acknowledge receipt of these letters!

The following are copies of the six letters exchanged between Dr. D. Anderson & Dr. T. Theman between Aug. 20 & Oct. 15, 2010:

1. ANDERSON TO THEMAN: Aug. 20/10
"I am publishing a book entitled 'Rot At The Top' (How Health Care Authorities in Alberta Ignore Patient Neglect and Needless Suffering).
I am attempting to obtain material from all recipients of the Anderson Journal on the Hon. Dave Hancock and its Addendum in order to get a balanced overview to be published in 'Rot At The Top'. Much of the material for this book has been received. I am inviting you to contribute material for this book. As a recipient of both the Anderson Journal on the Hon. Dave Hancock (July 2008) and its Addendum (Oct. 2008), do you have any comments or material that you wish to contribute to this book?

One section of this book will be covering The College of Physicians & Surgeon of Alberta. The CPSA conducted a totally flawed and incompetent investigation and submitted lies to justify the closing of patient complaint file #060421.1.4.
Please find enclosed copies of the following letters: -
-Dr. Mazurek to Dr. Anderson: March 7/07
-Dr. Anderson to Dr. Mazurek: March 12/07
-Dr. Anderson to 'Investigation Chairman?': April 10/07
-Dr. Anderson to Dr. Theman: November 21/07
I have established clearly that the College Staff submitted lies in the closing of file #060421.1.4  I asked you to investigate these lies. Did you do so? Did you find the origin of these lies and what action did you take? You have urged me repeatedly to APPEAL.
Lies by the College Staff cannot be resolved by a patient complaint appeal where the Chairman of the Investigating Committee, who is a member of Council and who closed the file and accepted the lies of the College Staff and is also a colleague of the three Councilors who form the Appeal Board (if in fact he is not one of the Appeal Board) - (this comprises a 'cosy kangaroo court').
Is the President of Council one of the three Councilors who comprise the Appeal Board?

The CPSA is a SELF-REGULATED PROFESSION.  I wish you to clarify for me what
SELF-REGULATED MEANS.
- Who Are the Regulators?: The senior college medical staff? The senior college non-medical staff? The medical council members? The non-medical council members? Others?
- Who Are the Regulated?: The licensed medical practitioners in Alberta (this is obvious). Registrar?
The senior medical staff? The senior college non-medical staff? The medical council members? The non-medical council members? Others?
Would you please confirm and clarify all of the above to assure accuracy of information before publication".

2. THEMAN TO ANDERSON: Aug. 27/10
"In your letter you invited my contribution of material for your planned book. Respectfully, I decline the invitation.  The answers to your questions are available to you by review of the Health Professions Act, the Medical Profession Act (which applied at the time of your complaint), and our website".

3. ANDERSON TO THEMAN: Oct. 4/10
"Thank you for your letter of Aug. 27/10 (copy enclosed). The Health Professions Act & Medical Profession Act  are unable to answer my questions, but you can.  I require clarification on the following:
- Was Dr. James Bell (President of Council of CPSA) one of the three councilors who constituted the Appeal Board of the CPSA, at the time of closure of file #060421.1.4 (Dr. Mazurek letter to Dr. Anderson date March 7/07?
-Was the Chair of the Investigating Committee (who is the Councilor who closed file #060421.1.4 and whose name the CPSA have concealed from me) one of the three councilors who constituted the Appeal Board of the CPSA, at the time of closure of this file (Dr. Mazurek letter to Dr. Anderson dated
March 7/07?
- Subject of SELF-REGULATION: Who are the Regulators? Who are the Regulated?

I await your clarification".

4. THEMAN TO ANDERSON: Oct. 7/10
"I acknowledge receipt of your letter of Oct. 4/10.  Some of your questions are rhetorical and neither require nor deserve a response. At the time that file 0604210104 was closed (March 2007), the President of Council was Dr. Jim Bell and the Investigation Chairman (not the chair of the investigating committee as there was no investigating committee constituted for your complaint) was Dr. Harvey Woytiuk.
The Investigation Chairman has never been and would never be a member of an appeal panel with respect to a file that the Investigation Chair had closed.
As you are a member of the medical profession, I am quite sure you understand that the CPSA is the regulator of the practice of medicine in Alberta. The Council of the College is the governing body.  It hires me and my staff to implement its policies and direction. Licensed members of the profession are the regulated members".

5. ANDERSON TO THEMAN: Oct. 13/10
"I acknowledge receipt of your letter of Oct. 7/10.  Thank you for pointing out some inaccuracies in my letter to you dated Oct. 4/10.  It is very important that all facts are completely accurate before publication  in my book.
The Investigation chairman who closed patient complaint file 060421.1.4 is not the same person as the Chair of the investigating committee.
Thank you for informing me that the Investigation Chairman of patient complaint file 060421.1.4 was
Dr. H. Woytiuk.  The CPSA has concealed this from me until now.
Unfortunately, you have failed to address my question concerning Dr. James Bell, who was President of Council of CPSA at the time of closure of file 060421.1.4
Your letter of Oct.7/10 states - 'The CPSA is the Regulator of the Practice of Medicine in Alberta.
The Council of CPSA is the Governing Body. It Hires Me and My Staff to Implement its Policies and Direction. Licensed Members of the Profession are the Regulated Members'.
I have several questions for which I require answers from you:
- Why did you ignore my question concerning Dr. James Bell?
-Are the Medical Staff employees of the CPSA, licensed members of the profession? If so, then the Medical Staff Employees of the CPSA are regulated. If these employees are regulated, who regulates them?    I await your reply to my questions".

6. THEMAN TO ANDERSON: Oct. 15/10
"I have no comment on your latest correspondence beyond acknowledging receipt".

Albertans will decide the CREDIBILITY OF DR. T. THEMAN before a Public Judicial Inquiry into problems in Alberta Health Care.
